SEAM Agency (Pty) Ltd ("SEAM", "we", "us", "our") operates the SEAM platform, an online marketplace and directory that connects South African creative professionals (photographers, models, videographers, stylists, designers, and others) with brands, agencies, and production companies seeking creative talent.

You must be at least 18 years of age to create an account on SEAM. By registering, you represent and warrant that:

• You are at least 18 years old.
• You have the legal capacity to enter into a binding agreement.
• All information you provide is accurate, current, and complete.
• Your use of SEAM complies with all applicable South African laws and regulations.

To access most features of SEAM, you must register for an account. You are responsible for:

• Keeping your login credentials confidential.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorised access or breach.

SEAM reserves the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or are inactive for an extended period.

SEAM supports multiple user types: creative professionals, independent models, model agencies, and brands. Each role has specific features and responsibilities:

• Creative and model profiles are publicly visible on the SEAM directory once SEAM Approved.
• Pending profiles retain private dashboard access, while public listings, project applications and booking eligibility require SEAM approval.
• Brand accounts are for organisations seeking to hire creative talent and have access to brief posting and talent matching features.
• Agency accounts may submit rosters of models for review and listing on the platform.

You are solely responsible for the accuracy, legality, and content of your profile, including any photos, descriptions, rates, and portfolio items you upload.

SEAM provides tools to facilitate booking requests, project inquiries, quotes, and direct messaging between users. Important terms:

• SEAM is a facilitating platform only. We are not a party to any agreement made between a creative and a brand or agency.
• Contracts, payments, and deliverables are agreed directly between the parties.
• SEAM does not guarantee the quality of services delivered by creatives or the accuracy of briefs posted by brands.
• You agree not to misuse the messaging system for spam, harassment, or unsolicited commercial communications.
• SEAM reserves the right to review communications where platform abuse is reported.

Certain SEAM features require an active paid subscription or plan. By subscribing, you agree to:

• Pay the applicable subscription fee as displayed at the time of purchase.
• Subscriptions are billed per the selected period (monthly, quarterly, or annually).
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — no prorated refunds are provided.
• SEAM reserves the right to change subscription pricing with 30 days' notice.
• Payments are processed securely by PayFast. SEAM does not store payment card details.
• Subscription access will be revoked upon cancellation or non-payment.

You retain ownership of all original content you upload to SEAM (photos, portfolio items, descriptions). By uploading content, you grant SEAM a non-exclusive, royalty-free licence to display, reproduce, and distribute your content on the platform for the purpose of operating and promoting SEAM.

SEAM's platform code, branding, design, and proprietary features remain the intellectual property ofSEAM Agency (Pty) Ltd. You may not reproduce, distribute, or create derivative works from SEAM's intellectual property without written permission.

You agree not to:

• Post false, misleading, or fraudulent profile information.
• Impersonate another person or organisation.
• Upload content that is unlawful, offensive, defamatory, or infringes third-party rights.
• Attempt to scrape, copy, or harvest user data from the platform.
• Circumvent or interfere with SEAM's security or access controls.
• Use the platform for any purpose that violates South African law.
• Engage in harassment, discrimination, or abusive behaviour toward other users.

SEAM reviews completed creative, model and agency profiles before granting the SEAM Approved badge. The review considers the profile, portfolio and professional information supplied through the platform; no selfie is required. SEAM Approved means the profile has passed SEAM's platform review and is not a guarantee of government-issued identity, qualifications, conduct or future performance. SEAM may request changes, reject, suspend or revoke approval if information is incomplete, misleading or inconsistent with platform policy.

To the maximum extent permitted by law, SEAM shall not be liable for:

• Disputes or losses arising from agreements between platform users.
• Loss of revenue, bookings, or opportunity resulting from platform downtime or errors.
• Inaccurate or misleading content posted by users.
• Unauthorised access to your account resulting from your own negligence.

In no event shall SEAM's total liability to you exceed the total subscription fees you paid to SEAM in the six months preceding the claim.

You agree to indemnify and hold harmless SEAM Agency (Pty) Ltd, its directors, employees, and partners from any claims, damages, or expenses (including legal fees) arising from your use of SEAM, your content, or your violation of these Terms.

You may delete your account at any time from your Settings page. SEAM may suspend or terminate your account without notice if you breach these Terms or engage in conduct that harms other users or the platform.

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.

We may update these Terms from time to time. Continued use of SEAM after changes are posted constitutes your acceptance. Material changes will be communicated via email or in-app notification.
